These Terms of Use govern your access to and use of the Flowgear website at flowgear.net (the “website”). By accessing or using the website, you agree to be bound by these terms and all applicable laws and regulations. If you do not agree, you must not use the website.
These terms apply to the website only. Your use of the Flowgear platform, the Flowgear Console and Flowgear Services is governed by the Master Services Agreement, not by these terms.
Use of this website
The website is provided for general information about Flowgear’s integration platform, connectors, services and company. When using the website, you must not:
- use the website for any unlawful purpose or in violation of any applicable laws or regulations;
- attempt to gain unauthorised access to any part of the website, its servers, or any connected systems or networks;
- introduce viruses, trojans, worms, or other malicious or harmful code;
- scrape, crawl, or use automated means to extract content from the website without prior written consent;
- impersonate any person or entity, or misrepresent your affiliation with any person or entity; or
- interfere with or disrupt the operation of the website or the servers and networks that host it.
The Flowgear platform
Descriptions of the Flowgear platform, connectors, pricing and services on this website are provided for general information only and do not constitute a binding offer, quotation, or contractual commitment. Sign-up, trial, proof-of-concept and production use of the platform are governed by the Master Services Agreement and the applicable Service Schedules.
Intellectual property
All content, trademarks, logos, graphics and materials on this website including the Flowgear name and marks, are the property of Flowgear or its licensors and are protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from any content on this website without prior written consent from Flowgear. Limited personal, non-commercial use is permitted provided that all copyright and proprietary notices are retained.
Disclaimer and limitation of liability
This website and its content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Governing law
This website is operated by Flowgear (Pty) Ltd. These Terms of Use are governed by and construed in accordance with the laws of the Republic of South Africa, and you submit to the non-exclusive jurisdiction of the South African courts in respect of any dispute arising from your use of the website.
This does not affect the governing law of the Master Services Agreement, which is determined by your contracting entity and region under clause 25 of that agreement.
Severability
If any provision of these terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
Changes to these terms
We may update these Terms of Use from time to time. Changes will be posted on this page with a revised effective date. Your continued use of the website after any changes are posted constitutes your acceptance of the updated terms.
